affirmed a trial court’s order to dismiss the prospective adoptive parent’s
adoption petition. The court held that the potential adoptive mother did not
have standing to adopt after the birth mother rescinded her relinquishment
due to changes in the adoptive family. In addition, the court found that the
birth mother had not abandoned her child by placing him for adoption.

IOWA: “Adoption
changes lead to danger, hope”

Due to increasing use of the Internet and national
advertising, adoptions are crossing state
lines more than ever before. While many
view this as a good change, the laws in
each state vary, which can lead to serious
problems. A new class of adoption professionals,
called facilitators, are earning as much
as $7,000 for matching up adoptive parents
with birth mothers, and often they have
no license or specialized training. In
a highly publicized case, Baby Jessica
was transferred from her adoptive family
in Iowa to her birth parents in Michigan
when she was two years old. Her birth father
claimed he was unaware she had been placed
for adoption. The major effect was that
adoptive parents became more aware of the
dangers of adoption. However, the majority
of the time, adoptions are processed smoothly.

KENTUCKY: “Dispute
Raises Questions About Kentucky
Law in Adoption Cases”
Kentucky
adoption law is under extensive examination as it currently does not have
a registry allowing men to
sign up with the state to be
notified if a woman with whom
he has had sexual relations
seeks to place a child for
adoption. Kentucky law also
allows a mother to terminate
rights to her child without
naming the father. This poses
a problem for birth fathers,
such as Khalid El-Shazly, who
have no idea that they either have a child, or what rights they do have,
should the mother choose to
place the baby up for adoption.
El-Shazly, who recently was
deported to his native Egypt
for overstaying his visa, filed
suit in U.S. District Court
against the birth mother’s attorney, who assisted the
birth mother with the adoption proceedings of his 18-month old son. The boy,
who was born in April 2004, spent his first 18 months in Wisconsin with his
adoptive parents. Then a jury and judge decided he belonged with El-Shazly.
El-Shazly alleges that the attorney advising the birth mother had dual roles
that created a conflict of interest. El-Shazly claims that the attorney pressured
the birth mother to go through with the adoption and instructed the birth mother
to keep the father's identity secret from the court so the adoption agency,
which is owned by the attorney, could collect a $6,000 fee when the adoption
went through. The birth mother makes the same allegations in a separate suit.
The attorney, Carolyn Arnett, contends that El-Shazly, who lived in Northern
Kentucky, lost his child because Kentucky has "bad laws" that provide little
protection to fathers.

MISSOURI: “Orphanage vs. Foster Care, a Study.”
Dr. Dana Johnson,
a pediatrician and adoption specialist
at the University of Minnesota,
conducted an experiment with her
colleagues to compare children
raised in orphanages to children
placed into foster care. The Romanian
Government enabled the researchers
to carry out their experiment by
placing 69 children in foster homes
and leaving 67 in orphanages. The
results from the experiment demonstrated
the positive impact the nurturing and
caring from foster homes can have on
children’s overall well-being.
The foster care children had marked
improvements in their physical, emotional,
and intellectual growth. After the
children were placed in foster care,
they began to gain weight and showed
fewer signs of depression and anxiety.
In addition, Dr. Nathan Fox of the
University of Maryland reported that
at 42 and 54 months, the foster-care
children showed increases in their
IQ scores. The researchers concluded
that the findings from this experiment
are not specific to Romanian children;
they can be applied to all children.

parentless children in Sub-Saharan Africa. Maisha Strozier, an American, has
been attempting to adopt two Nigerian children for over three years, but has
met obstacle after obstacle. She has even taken her case all the way to the
Nigerian General Assembly in an attempt to ease adoption laws. The assembly
opted instead to tighten the laws.

parenthood”
A circuit court judge ruled that the Missouri Department of Social Services
was wrong to deny Lisa Johnston’s foster parent application solely because
of her sexual orientation. Johnston applied to be a foster parent in 2003 in
Kansas City, and was hoping to raise a child with her partner. Her application
was turned down due to what the ACLU said was an unwritten policy preventing
gays and lesbians from serving as foster parents. Social services claimed that
a child raised by a same-sex couple could face social disapproval, but these
claims weren’t supported by any substantial evidence.

MARYLAND: Nationwide Insurance Company v. Chloe Ann Jones, et al.
The United States District Court
for the District of Maryland granted an insurer’s motion for summary
judgment in part and denied it in part in the insurer’s declaratory judgment
action. The insurer asked the court to declare that it had no duty to defend
and indemnify the insured foster mother and her biological minor daughter,
for injuries sustained by a foster child who was in foster care with the insured.
In an underlying lawsuit, the biological mother of the foster child was seeking
damages for injuries sustained by the foster child. The court in the immediate
action found that the foster child’s claim against the insured’s
daughter was covered by the insurance policy because the injury to the foster
child was incurred as the result of an alleged accident. The court found, however,
that the insured was not covered by the policy because of an exception in the
policy that it did not cover bodily injury “arising out of business pursuits”.
Because the insured was receiving money for being a foster parent, that was
considered a business pursuit.

a long wait to adopt Down syndrome
child”

Three
years ago, Diane and David Petersohn,
who already have seven children, decided
they wanted to adopt another – specifically
a child with Down syndrome. They were placed
on a national list, and waited and waited.
Finally, they turned to a private agency
specializing in international adoptions
and they’re completing paperwork
to adopt a 6-month old Ecuador boy with
the Down syndrome. David Tolleson of the
National Down Syndrome Congress said that
society has become much more accepting
of people with Down syndrome, when in other
generations mothers who gave birth to children
with Down syndrome were told to place their
child in an institution. Another family,
the Steeles, have adopted nine children – three
with Down syndrome. They also started
the Adoption Awareness Program, in conjunction
with the Down Syndrome Association of
Cincinnati.

When approaching an adoptive parent or child, the word choice of people
should convey the maximum amount of respect for both the families and the
adoption process. Positive Adoptive Language
(PAL) is a vocabulary created to do just
that. “The first rule in PAL is to not ask, ‘Is this your real
child?’. As opposed to being your fake child? Of course he is a real
child, he is living and breathing just like you and me,” says Valarie
Roberts, an etiquette expert. Also, it is natural to be curious or interested
about the cost of adoption, but it is not an okay question to ask. Instead,
ask for the name and number of the agency the family used and the agency
can provide you with more information. Finally, do not ask about the birthparents
in front of the child unless you are certain that the adoptive parents are
comfortable with such an inquiry, and when referring to the birthparents
they should be spoken of sympathetically and in the past. It is
important for the child to feel pride in their birthparents, and to know that
they wanted them to live happily with their adoptive parents.

Coalition in order to raise the community’s awareness and combine their

foster care”

The
state of Maryland has increased their budget to implement programs to improve
the state’s foster care system, led by Governor Robert L. Ehrlich Jr.
His wife will star in a public service announcement that promotes foster care.
Governor Ehrlich approved the hiring of 130 additional child welfare caseworkers.
Under his new plan, foster parents would receive $25 more per month for each
child in their care and a Foster Parent Association will get $500,000 for training
and recruiting, a renewal of a prior pledge. Finally, Ehrlich will give an
additional $2 million to children’s crisis programs. The initiatives
come in part as a result of reports of the substandard foster care system
in the state.

VIRGINIA: “Adoption Changes
Proposed”

In order to eliminate the difficulties
that plague the adoption process as it currently stands, Virginia legislators
are considering several bills proposed by a group that spent several months studying
Virginia adoption law. For instance, the group introduced a proposal for a putative-father
registry. The registry would place the responsibility on the putative father
(a man who is presumed to be a child’s father but the presumption has not
been legally verified) to register with the service to inform the state of their
whereabouts. The state would then notify the registered putative father if his
potential child was being put up for adoption. Under current adoption policies,
proceedings are halted if the father is unknown, so that he may be found and
given a chance to object. For example, the birth mother’s attorney may
run ads in the local newspaper or hire a private investigator (the cost of which
is ultimately absorbed by the adoptive parents). Thus, proponents of the registration
system claim that it would not only help expedite the adoption process, but also
allow men to take a more active role as biological fathers. However, objections
to the registry include a fear that the birth father’s rights will be terminated
more easily if the man is unregistered. Other proposals include: shortening the
time that a birth mother has to revoke her consent to the adoption; creating
a mutual-consent registry which would allow adoptees over 21 years of age, birth
parents, and siblings to seek information about one another; clarifying provisions
which deal with abandoned children; allowing birth fathers 10 days after the
child is born to revoke their consent to adoption; and finally, creating a hybrid
between open and closed adoptions which would allow a woman to choose the adopting
family while keeping some aspects of her life private. The goal of these proposed
changes is wholly to make the adoption process easier, thereby encouraging more
families to adopt. As of December, 1655 children in Virginia needed adoptive
homes, and 889 were legally free to be adopted. However, in the 2005 fiscal year,
the Virginia Department of Social Services recorded 540 public adoptions and
72 private adoptions. The department’s figures reveal that the average
time a child waits in foster care for an adoptive home is 37.8 months with the
time varying with the child’s age.

CALIFORNIA: Guardianship
of L.V. v. J.M.
The Third Appellate District Court of
Appeals of California upheld the trial court’s decision refusing to terminate
a court-appointed guardianship and restore the appellants’ parental rights.
The court determined that since the parents had not been participating in the
day-to-day parenting for some time, they were not entitled to the constitutional
presumptions normally protecting parents acting in that role. The court found
substantial evidence supporting the trial court’s order terminating the
parental rights and decided that since the appointed guardians had been participating
in the day-to-day parenting for over 18 months, it would not be in the child’s
best interests to terminate the guardianship.

MISSOURI: Porter v. Coffman
A minor, Constance
Porter, died after being placed in
a foster home by the Missouri Division
of Social Services, and the parents
filed a suit for damages. The United
States District Court granted summary
judgment on the wrongful death claim
to defendants, Julie Coffman, a Department
of Family Services worker and her
supervisor Augustine Torres, based
on official immunity. The Court of
Appeals held that the District Court
was correct in granting summary judgment
to Augustine Torres based on official
immunity because he was Coffman’s
supervisor and was not under the
same mandate of legal authority as
Coffman. Because the supervision
of Coffman required exercising reason
and professional judgment, the Court
of Appeals found that Torres was
acting within the scope of his authority,
that his actions were discretionary
and, therefore, that he was entitled
to official immunity. The Court of
Appeals remanded the case in regards
to Coffman to determine whether the
required visits to the foster family’s
home were conducted. Upon deciding
this material fact, if the District
Court found that the visits were
made according to the consent decree,
Coffman would be protected by official
immunity because a social workers'
determinations based on home visits
are considered discretionary. However,
if Coffman had not made mandatory
home visits to the foster home, Coffman
would not be shielded by the official
immunity. The judgment of the district
court was reversed in part, affirmed
in part, and the case was remanded.

District, Division Eight, affirmed
a decision of the trial court, which
terminated the mother’s parental
rights. If a court finds by clear
and convincing evidence that a child
is adoptable, it will terminate parental
rights unless the parent maintains
regular visitation and contact with
the child and termination of parental
rights will not be detrimental to
the well-being of the child. Cal.

The court determined that where the
mother could not establish that she
had maintained regular visitation
and contact with the child and where
she could not show that her child
would suffer any detrimental harm
from the termination, it was in the
child’s best interests for
the mother’s parental rights

the child had spent more time in
foster care than with the mother,
and had bonded well with her prospective
adoptive mother.

ALABAMA: R.P. and J.T.P. III v. State Department of Human Resources
The Court of
Civil Appeals of Alabama reversed a decision of a juvenile court, which held
that termination of parents’ rights was in the children’s best
interest because of unsanitary living conditions in the home. The appellate
court determined that parental rights may be terminated when the parents are
unable or unwilling to discharge their responsibilities to the child and such
conduct or condition is unlikely to change in the foreseeable future. Ala.
Code 1975, §§ 26-18-7(a)(1)-(6) and (b)(1)-(4) list factors a juvenile
court must consider in making the difficult decision to terminate parental
rights. Among those factors are that efforts to rehabilitate the parents have
failed, § 26-18-7(a)(6), and, when the child is no longer in the custody
of the parents, the lack of effort by the parents to adjust their circumstances
to meet the needs of the child in accordance with agreements reached with the
child welfare agency. Ala. Code § 26-18-7(b)(4). The court held that termination
was not in the best interests of the children because there was a potential
viable alternative available, such as the assistance of the maternal grandmother,
or financial assistance in getting psychiatric therapy for a parent who was
willing to attend. The court determined that it was evident that the parents
loved the children and had made viable efforts to rehabilitate, but that they
needed additional assistance with parenting and personal hygiene skills.

NEW YORK: “Another Child, Beaten to Death”

After
seven-year-old Nixmary Brown was tortured
and beaten to death, even after child
welfare officials received reports
that she was at risk, New York officials
have been reviewing cases and procedures.
The proposed reforms came too late
for four-year-old Quachaun Browne,
who was beaten to death last week,
even though there were half a dozen
reports of trouble that had brought
caseworkers to the apartment where
the boy lived. Caseworkers actually
went into the apartment four times
in recent months but saw nothing dangerously
out of line. They also failed to determine
that Quachaun’s mother had a
new live-in boyfriend, who has now
been charged with the murder of Quachaun.
Quachaun’s death highlights the
need for better investigative skills
on the part of caseworkers. The city’s
proposed improvements should provide
those skills, quickly.
